The applicant is Mrs Angela Percival, the agents of the Rural Planning Practice, case officer Helen Cooper, and the recommendation is to permit.

Yes, so this application has been brought to Planning Committee in accordance with thescheme of delegation and planning protocol as the application site has an area exceeding
one hectare.
So I'm just going to get the slides up now for you.
So this is where the application site is located.
It comprises an agricultural field measuring approximately five and a half hectares in
area which is set on the edge and to the east of Preston.
The A419 runs parallel to the eastern boundary of the site and the public right of way runs
along the northern boundary.
The site benefits from existing field access with a hard surface area in its northwest
corner which provides parking and space for turning vehicles.
So the planning application seeks permission for change of use of the site to a mixture
of agricultural and equestrian use.
It should be highlighted that agricultural land can be used past relief for the grazing
of horses without a change of use taking place.
However, in this instance, to regularize the keeping of horses
at the site for personal use only, the applicant is seeking
planning commission.
And the applicant is currently keeping three horses
at the site.
And so this image here shows the field, and then you can see its
kind of position in relation to Presti.
And you can see the area in green is the conservation area
on the site location down there, so it's some distance away.
And it leads to some images of the field.
So there's the area of hard standing
that I was just referring to for the cars and the field gates.
So there is an existing field shelter on the site
which is currently used by the applicant.
However, planning permission is not being sought
for that structure as the applicant considers it
to be a temporary mobile structure.
It should be noted that the site isn't
in the national landscape.
However, as outlined in the neighborhood development plan
for Preston, the surrounding fields
in this area hold local landscape value and contribute positively to the rural
character of the village. The proposed change of use is considered to retain
the rural character of the site and in principle a mixed equestrian and
agricultural use is acceptable in a countryside location such as this. A
planning condition has been recommended and this restricts the use of the site
for private use and this will help minimize any potential impact on the
amenity of neighboring properties and kind of the highway safety implications.
The application is therefore considered to accord with all relevant policies
within the local plan and it is recommended that Planning Commission be

Councillor Judd. Could you explain or clarify the sort of change of use aspect?I mean, how does that affect how the land is considered from this point by the planning
officers?

Yes, so in terms of agricultural use, if, like I've kind of said just then, if it wereto be used for the grazing of horses, it doesn't really need a change of use to equestrian
use.
It's kind of quite a finely balanced distinction, so when it tips over to needing the equestrian
use.
You know, for instance, if they're kind of keeping horses
permanently on site, which is really the intention,
but they're also intending to use it agriculturally.
I think they're proposing to use it really for hay,
so you know, they're just going to be kind of mowing the longer
grass and kind of create, it's part of the agricultural use.
But they would just run alongside each other.

Yes, it would have a mixed use, so they can use it forequestrian purposes or agricultural or one or some
parts of the field, it's envisaged, will be used
agriculturally for the hay growing, and other parts will
have the horses on it.
It's a very large site, five and a half hectares, so they
planning on rotating the horses around the field to kind of graze parcels of land.
So yes, so a mixture.

Thanks very much. Just a quick declaration.I have a rental unit on Preston Village Farm,
so I'll just say that.
I don't know the applicant or anything like that,
but I do know the land pretty well.
It is very large, and it is by the 417,
so it's not a very peaceful area, I have to say.
Look, there's been no objections from anybody.
You're recommending permit. It's a change of use.
It seems to me that I find it very hard to find a reason not to support this.
But I noticed that one representation from Pine Corner, and they've said that the field shelter has resulted in smell of manure and so on and so forth in summer weather.
They have said they're quite happy. They don't really have an objection to this.
Is there any way we can condition it to ensure that maybe that field shelter is never less than x
meters or whatever from from
residential property
No, unfortunately, they're not actually seeking permission for the

Condition 6 removes PD rights for walls or fences which could, in theory, be erected.
We could add structures into that if members wanted a belt and braces approach, although
I would tend to say I don't think it's necessary because equestrian uses don't have PD rights.
Any permanent development on the site would require planning permission in its own right.
The reason this one doesn't is because it is a temporary movable structure, so in planning
terms isn't development, so we have no control over it, which
is sort of why we can't control that one.
But could we control the storage of manure?

Well, I have kind of recommended an informative at the end of theCommission after kind of, you know, which basically says it
could, if it were to cause a statutory nuisance, there are,
we do have steps that we can take that's really in the
applicant's interest to try and manage it effectively.
And again, they are rotating the horses around the site, and their
plan is to harrow the manure kind of into the ground so not actually
proposing to have manure heaps anywhere which will help matters all trailers so
really that was kind of considered to be sufficient the emphasis is placed on
them but there are steps we can take if it did cause a nuisance statutory

We'll move on to the next application. This is for the construction of agricultural buildingat the Barnhales Farm, Clavis Hill, Jedworth. The applicant is Mr Jeremy Thayer. Case officer
is Graham Smith. Recommendation is to permit. So over to you now, Graham, for your report please.

Thank you, Chair. The application has been brought to planning committee because the applicant isa ward councillor. The application is for an agricultural building
relevant to the applicants land holding of about 1 .1 hectares. The applicant's own
residence which is the barn which members may recall from the committee a
couple of months ago is located to the south of the site. The application
site includes an existing stable building that was granted planning permission in 2019.
There was also a temporary permission for a polytunnel located to the north of the stable
building. That temporary permission has expired and the building has been removed.
The proposed site plan is for an agricultural building that would be located directly to
the north of the stable building.
It would be constructed predominantly of concrete blocks at base level, timber cladding above

that and then with a corrugated steel roof which would be coloured dark green.
So it's a fairly atypical, modern, agricultural building of fairly, materials are commonplace
throughout the district.
Floor plan, simple, open, used for basically for the storage of fodder relating to the
applicants flock of sheep.

That's the existing stable building.
Another looking, that's looking actually towards the applicants
residence which is to the south of the application site.
It's a site looking to the north.
And again to the north.

The site is surrounded by a number of public footpaths.
There is a restrictive byway that runs to the north.
That forms a northern boundary.
There are views across the valley from Cheap Street,
looking towards the tree line.
There's two banks of trees, one in the foreground of the site,
and then one to the rear by the restricted byway.
So north of the site where the restricted byway is,
You can get glimpsed views through the tree line.
They are glimpsed views.
It is quite a dense bank of woodland and planting.

expressed concern that a particular building wasn't necessarily redundantand disused as it had been erected in 2015 and therefore you know should it
really be converted into residential accommodation and and he said again very
wisely that he thought that that policy EC6 was designed for old barns and things like
that, not stables that were built in 2015. Is there a danger, I mean I'm only putting
this out there, that in five years' time we're sitting here, well probably won't be us, but
the local planning authority in five years' time is considering an application under whatever
the equivalent of EC6 is there because the applicant needs more room to spread their
family around.

Unfortunately, this could be that age old on a case by case basis on its own merits.There's nothing stopping us, you know, someone submitting an application to us in five, ten
years.
We would have to consider it at the time based on the policies we have adopted at that time.
So it's entirely possible that in five years' time the local parish council or some objector
